Still No Gay Marriage in Alabama

An Alabama federal judge has stirred up the same-sex marriage issue once again in Alabama with a new order attempting to overrule the Alabama Supreme Court. This judge fails to recognize that her orders are outside of her scope of authority. We unequivocally stand with Chief Justice Roy Moore and the Justices of the Alabama Supreme Court in fighting on behalf of Alabama's legally passed protections of natural marriage.

U.S. District Judge Callie Granade has once again attempted to permanently overrule the Alabama Supreme Court regarding marriage. According to Granade, her order is needed because state laws against same-sex marriage remain in effect after the Alabama Supreme Court affirmed earlier orders that prohibited probate judges from issuing
marriage licenses to same-sex couples.

Judge Granade has no authority over the Alabama Supreme Court, but she is acting as if she is the top appellate court in the state. The only Court that has authority over the Alabama Supreme Court is the U.S. Supreme Court.

Nonetheless, there was one benefit to the Judge's order... With her order, Judge Granade has affirmed the need for clarification on issuing "same-sex" marriage licenses in the state. That clarification was provided earlier this year by Alabama Chief Justice Roy Moore when he issued an Administrative Order advising probate judges that the state's orders remained in effect: no "same-sex marriage" licenses were to be issued. In March 2016, the Alabama Supreme Court affirmed the 2015 orders.

Because of Justice Moore's Administrative Order, he became the target of unfounded and politically motivated complaints filed against him with the Alabama Judicial Inquiry Commission (JIC) by left-leaning organizations and pro-homosexual activists.

Liberty Counsel has filed a federal lawsuit against the JIC that raises constitutional challenges to their charges against Chief Justice Roy Moore and the "automatic removal" provision of the Alabama Constitution.
