The US Constitution

The best presentation on this topic is a video by Publius Hulda, a Constitutional Attorney from Tennessee. Her video on the U.S. Constitution called “Straight Talk about an Article V convention” is on her website: http:publiushuldah.wordpress.com/
There are two sides who battle the issue of whether or not a Law is Constitutional.  We Tea Partiers and many other conservatives hold that the words in the US Constitution governs this question.  Progressives claim that the Constitution should be a “living document” and the courts should decide.
We Constitutionalists believe that our elected officials who passed and signed unconstitutional Bills into law were violating the Constitution they swore to uphold.  We believe that the federal government is confined to the enumerated powers contained in the Constitution.  We argue that these unconstitutional laws are not valid and our elected officials in the House and Senate need to repeal these illegal federal laws, follow the 10th Amendment and send these matters to the states.  We think the Progressives are trying to wreck the country by ignoring the “rule of law” established by the Founders.
Progressives infiltrated elective office and the courts around 1900 and by 1913 they had already passed several unconstitutional laws, not based on the words, but based on their decision to ignore the Constitution.  Their excuse was that they believed the Constitution was a “living document” that could not be strictly interpreted and still allow them to do what they wanted to do.
Since then, the federal government and the courts have used a court rubber stamp process to passing laws they are not empowered to legally pass.  Most of what the federal government now controls are illegally usurped powers that belong to the states and the people.
States that should have invoked their 10th Amendment rights have been “bribed” into playing along with the scam.
The enumerated powers granted by the states to the federal government include:
Federal government of 3 branches (legislative makes laws, executive enforces laws,  judicial adjudicates disputes):

Has lawful power only over these objects (for the Country at large):

External:
International trade & diplomacy
War, national defense
Make Treaties, but only on objects authorized by Constitution!

Internal:
Establish uniform commercial system:
weights & measures
patents & copyrights
money system (gold & silver)
bankruptcy laws
mail delivery & road building

Laws on naturalization & immigration
Certain civil rights (in the Amendments)
Make & enforce only a few criminal laws
Federal courts for specific purposes only
Miscellaneous _housekeeping_: census, etc.
May borrow money & levy taxes, but only for purposes authorized by Constitution!

God given Rights secured by federal government :
Life (military, pirates, traitors, secure borders)
Property rights: honest money, weights & measures, patents & copyrights, bankruptcy law
Limited & enumerated powers secure right to be left alone!
Fair trials in federal courts

Now the scam is unraveling. The federal government is unsustainably broke and it’s time to fess up and fix this mess.
Norb Leahy, Dunwoody GA Tea Party Leader
