Dem State: 64 Year-Old Man Facing Felony Charges For Defend Himself In
His Own Home, by Jessica Hardy, 6/23/19.
This is one of those stories that make our blood boil but we
have to cover them because this is the type of cases gun-owners need to keep
their eye on. Democrats are always promising that stricter gun-control will
keep lawful citizens safe but The Daily Signal just uncover a story
where a homeowner is facing felony charges for defending himself- in his own
home!
Because the homeowner didn’t have the time or money to register
the gun in his own name he now faces spending the rest of his life in jail. The
gun the man used, that was in his private residence, belonged to the man’s
father and was left to him after his father’s death.
“Just look to the case of Ronald Stolarczyk of Oneida County,
New York. He’s now facing felony charges for lawfully protecting himself
against criminals without first getting the county’s permission to possess a
handgun in his home—something that would cost him hundreds of dollars and
months of paperwork.
The 64-year-old Stolarczyk was “minding his own business in
his kitchen”
one day when he heard voices coming from his garage. Stolarczyk tried simply
waiting for the intruders to leave, but the two assailants soon ascended the
stairs and attempted to enter his central living space.
Stolarczyk then yelled at the burglars to leave, hoping that
knowledge of his presence would scare them away. The burglars were undeterred
by his warning, and one even aggressively advanced toward him.
Stolarczyk now feared for his life, both because his home had
previously been broken into and because he was aware of recent home invasions
that resulted in the death of the homeowner.
Stolarczyk quickly retrieved his deceased father’s .38-caliber Rossi revolver and fired several
rounds at the burglars.”
One of the alleged burglars, identified by state
police as 57-year-old Patricia Anne Talerico of Utica, was pronounced dead
at the scene. The second alleged intruder, her nephew, 27-year-old Nicholas
Talerico of Utica, was transported to a hospital and died of his injuries.
“The word that we had originally was a possible home invasion,
possible suspect running at large,” New York State Police Trooper Jack
Keller told
WSYR-TV.
“We were able to quickly identify who those people were identified as…but also
we were able to determine quickly that there was no one else and the public was
not in danger at all.”
Police said they found items belonging to Stolarczyk at
Nicolas Talerico’s home, indicating he may have burglarized his home
before, WCSI reported. It’s unclear
if Stolarczyk knew him.
Stolarczyk was arrested and charged with criminal possession of
a firearm and was transported to the Oneida County Jail,
where he’s awaiting centralized arraignment, according to state police.
Does this sound like ‘stricter gun laws’ are really working out
for law-abiding citizens to you? Should a homeowner really be required to
register a handgun used for personal-in-home protection? Let us know your
thoughts in the comments below.
